Rubbish Collection Greenwich Terms of Service

These Terms and Conditions set out the basis on which Rubbish Collection Greenwich provides waste removal and related services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Rubbish Collection Greenwich.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the person, business, or organisation that requests and pays for rubbish collection or waste removal services.

Company means Rubbish Collection Greenwich, the service provider.

Services means any rubbish collection, waste removal, clearance, loading, transport, or disposal service provided by the Company.

Waste means any items, materials, or rubbish that the Customer presents for collection in connection with the Services, excluding any prohibited or hazardous materials.

Contract means the agreement between the Customer and the Company for the supply of Services in accordance with these Terms and Conditions.

2. Scope of Services

The Company provides rubbish collection and waste removal services within its advertised service areas, including household clearances, garden waste removal, bulky waste items, and general rubbish collection.

The specific Services to be provided in each case will be agreed at the time of booking, based on the description of the Waste, the access conditions, and the Customer's requirements. The Company reserves the right to decline any booking where it considers the Waste unsuitable or the working conditions unsafe.

Services do not include cleaning, dismantling of complex fixtures, electrical or plumbing work, or any services not expressly agreed at the time of booking or in subsequent written confirmation.

3. Booking Process

Bookings may be made by telephone, email, or through any online booking system made available by the Company. The Customer must provide accurate information about the type, approximate volume, and location of the Waste, as well as details of access and any potential restrictions such as parking, time limits, or building regulations.

Any quote provided before an on-site assessment is an estimate only and may be subject to change once the Company has inspected the Waste in person. The Contract is formed when the Customer accepts the quoted price and confirms the booking, either verbally or in writing, and the Company accepts that booking.

The Customer is responsible for ensuring that the contact details provided at the time of booking are correct and up to date, and for being available at the agreed collection time or making suitable arrangements for access.

4. Estimates and Quotes

All prices given prior to viewing the Waste are provisional estimates based on the information supplied by the Customer. The final price may vary depending on the actual volume, weight, nature, and handling requirements of the Waste, as well as any additional work requested on site.

Once on site, the Company will confirm the final price before proceeding. If the Customer does not accept the revised price, the Company may cancel the Service, and any applicable call-out or minimum charge may still apply, as notified in advance.

Unless specifically stated otherwise, all prices are exclusive of VAT and any other applicable taxes, which will be added at the prevailing rate where relevant.

5. Payments and Charges

Payment is due on completion of the Service, unless otherwise agreed in writing in advance. The Company accepts payment by cash, bank transfer, or card, subject to the payment methods currently offered. The Customer must ensure that funds are available and that payment is made promptly.

For commercial customers or account holders, the Company may agree credit terms. Where such terms are agreed, invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

If payment is not received by the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate applicable under UK law, and to recover all reasonable costs of debt collection, including legal fees.

The Company may apply a minimum charge for small collections or for call-outs where no Waste is removed due to the Customer's fault or failure to comply with these Terms and Conditions.

6. Customer Responsibilities

The Customer must ensure that:

The Waste to be collected is clearly identified and accessible at the agreed time, and that the Company is granted safe and lawful access to the property or site.

Any necessary permissions, permits, or consents are obtained in advance, including building management approvals, parking dispensations, or access codes.

There are no sharp, dangerous, or contaminated items presented without prior notice, and that any such items are safely contained and disclosed to the Company.

The Waste does not include materials that the Company is not legally permitted or properly equipped to handle, such as certain hazardous or specialist wastes.

Parking arrangements are made where possible, and any limitations or costs associated with parking or access are communicated to the Company before the booking is confirmed.

7. Access, Parking and Waiting Time

The Customer must provide suitable access for the Company’s vehicles and personnel. If access is restricted or parking is unavailable at the agreed time, the Company may charge for waiting time, additional labour, or any re-attendance required.

Where parking fees or congestion charges are incurred directly in connection with the Service, these may be passed on to the Customer, either as part of the quoted price or as an additional charge where not reasonably foreseeable at the time of booking.

If the Company is unable to carry out the Services due to access issues or the Customer's absence, a call-out or wasted journey fee may be applied.

8. Cancellations and Amendments

The Customer may cancel or amend a booking by notifying the Company as early as possible before the scheduled collection time.

Where cancellation is made more than 24 hours before the agreed time, no cancellation fee will normally apply, unless specific arrangements or costs have already been incurred for that booking.

Where cancellation or significant amendment is made less than 24 hours before the agreed time, the Company reserves the right to charge a late cancellation fee or call-out charge, up to a reasonable proportion of the anticipated Service cost.

The Company may cancel or amend a booking at any time where circumstances beyond its reasonable control prevent the Service from being carried out safely or lawfully, including severe weather, vehicle breakdown, staff illness, or changes in legal or regulatory requirements. In such cases, the Company will seek to reschedule the Service at a mutually convenient time, and any prepayments will be carried forward or refunded as appropriate.

9. Waste Restrictions and Compliance

The Company operates in accordance with applicable UK waste management and environmental regulations. All Waste collected will be transported and disposed of or recycled through authorised facilities wherever reasonably practicable.

The Customer must not present the following types of waste for collection without the prior written consent of the Company: asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, pressurised containers, hazardous electrical items, or any other materials classified as hazardous or requiring specialist handling under UK law.

The Company reserves the right to refuse any Waste that it considers unsafe, illegal, or unsuitable for collection, transport, or disposal using its usual systems. If prohibited items are discovered among the Waste, the Company may remove them only on the basis of a separate agreement and additional charges, or may decline the Service in whole or in part.

The Customer is responsible for any fines, penalties, or additional costs incurred by the Company as a result of the Customer’s failure to correctly describe the Waste or to comply with applicable waste regulations.

10. Title and Risk in Waste

Title to the Waste passes to the Company once it has been loaded onto the Company’s vehicle and full payment has been or will be made in accordance with these Terms and Conditions. Up to that point, the Waste remains the property and responsibility of the Customer.

The Company may, at its discretion, sort, recycle, reuse, or dispose of the Waste in any lawful manner after collection, subject to its environmental policies and legal obligations.

11. Liability and Limitations

The Company will exercise reasonable care and skill in the performance of the Services. However, the Company’s liability to the Customer is limited as set out in this clause.

The Company will not be liable for any loss or damage arising from:

Incorrect or incomplete information provided by the Customer about the Waste, access, or site conditions.

Pre-existing defects, weakness, or wear and tear in structures, fixtures, surfaces, or items at the property.

Reasonable and unavoidable wear or scuffing to floors, walls, or access routes, provided the Company has acted with reasonable care.

Any indirect or consequential loss, including loss of profit, business interruption, or loss of opportunity, whether arising in contract, tort, or otherwise.

Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be limited or excluded under applicable law.

Subject to the foregoing, the Company’s total liability to the Customer in respect of any claim arising out of or in connection with the Services will not exceed the total charges paid or payable for the specific Service giving rise to the claim.

12. Insurance

The Company maintains appropriate insurance cover in respect of its vehicles, employees, and public liability as required by UK law and industry practice. Details of insurance cover are available on request.

The Customer is encouraged to maintain their own contents or business insurance to cover any items remaining at the property and any risks that fall outside the scope of the Company’s liability.

13. Complaints and Service Issues

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, and in any event within 48 hours of completion of the Service. The Customer should provide clear details of the issue, along with any supporting information.

The Company will investigate any complaint promptly and will seek to reach a fair resolution, which may include re-attending to complete or correct the Service where reasonable and appropriate.

Raising a complaint does not, in itself, suspend the Customer’s obligation to pay for Services already delivered, unless agreed in writing by the Company.

14. Data Protection and Privacy

The Company will collect and use personal information about the Customer, such as contact details, service history, and payment information, for the purposes of providing the Services, managing bookings, and complying with legal obligations.

The Company will handle personal data in accordance with applicable UK data protection legislation and will take reasonable steps to keep such data secure and to prevent unauthorised access or disclosure.

The Customer has the right to request access to personal information held by the Company and to request correction of any inaccuracies, subject to legal restrictions and identification requirements.

15. Events Beyond Our Control

The Company will not be liable for any delay or failure to perform its obligations under the Contract where such delay or failure results from events or circumstances beyond its reasonable control. These may include, but are not limited to, extreme weather, strikes, industrial disputes, accidents, traffic conditions, vehicle breakdowns, or changes in laws or regulations.

Where an event beyond the Company’s control affects the performance of the Services, the Company will endeavour to notify the Customer as soon as reasonably possible and will, where feasible, rearrange the Services for a later date.

16. Variation of Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the relevant Contract, unless a change is required by law or regulatory guidance, in which case the updated terms may apply immediately.

Any variation to these Terms and Conditions requested by the Customer will only be binding if agreed in writing by an authorised representative of the Company.

17. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Collection Greenwich.

19. Entire Agreement

These Terms and Conditions, together with any written quotation, booking confirmation, or invoice issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services. They supersede any prior discussions, correspondence, or representations, whether oral or written, relating to the subject matter of the Contract.

By confirming a booking with Rubbish Collection Greenwich, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
